The Nebraska Supreme Court has refused to removed convicted killer Carey Dean Moore's attorney from the case, keeping Moore's execution scheduled for next week.
Attorney Jeff Pickens cited a conflict of interest, saying Moore wants to die and it is his responsibility to try to prevent that from happening.
Moore's execution is scheduled for 10 a.m. Wednesday and it comes at a contentious time for the death penalty in Nebraska. A new lawsuit by pharmaceutical company Fresenius Kabi seeks to prevent the use of their products in the execution.
The suit was filed late Tuesday night, but Nebraska Attorney General Doug Peterson says the state obtained the drugs legally.
