Suspected deputy killer, Wesley Correa-Carmenaty will have an extradition hearing in Douglas county jail court on Thursday where he is currently being held.
He's accused of killing Pottawattamie County Deputy Mark Burbridge and wounding Deputy Pat Morgan when they were in the garage of the jail. Authorities say Carmenaty had just returned to the jail after being sentenced to 45 years in prison for the 2016 murder of a Council Bluffs man. The suspect was arrested after a chase in Omaha at the I-480 on ramp at Cuming St.
He's been booked on kidnapping, possession of a weapon, and flight to avoid arrest among other felonies at the Douglas County Jail but he'll likely be charged with murder, and attempted murder in Iowa.
If he waives his extradition hearing Wednesday he'll go back to Council Bluffs, but if Carmenaty doesn't they'll start the Iowa Governor's warrant process to bring him back likely in the next 60 days.
Kleine would then have to drop the charges when he’s extradited, but could refile them. He says it has to be done correctly.
"It's very important and that's why I contacted matt Wilber yesterday just to make sure we have the process figured out and we did everything we need to do in a proper manor to get him back over to Iowa," Douglas Co. Attorney Don Kleine explained.
Kleine says if the State of Iowa isn't satisfied with the outcome of their case he could refile charges. They would have 3 years to refile them before the statute of limitations run out.
