OMAHA, Neb. (KMTV) — On Monday, Frederick Franklin, the special prosecutor who handled the grand jury investigation into Jake Gardner for the killing of protester James Scurlock, filed a motion to dismiss the indictment against Gardner.
To support his motion of dismissal, Franklin included a copy of Gardner's death certificate, which confirmed he died by suicide in Oregon.
The judge signed off on the dismissal the same day.
