OMAHA, Neb. (KMTV) -- — An undocumented immigrant is punished for driving drunk and killing a metro area grandmother.
Vismar Carmona-Martinez, 21, is sentenced to 10-11 years in prison in Douglas County District Court. With “Goodtime” he'll be eligible for parole in 5 years.
Just after midnight on New Year's Day 2018, Ann Smock's vehicle stalled on northbound Highway 75 near “L” Street. Her vehicle wasn't completely on the shoulder when Carmona-Martinez, then 19, hit her going 56 miles an hour. He had a Blood Alcohol Content of .240.
“It's a tremendous loss,” said Patti Trotter, friend. "I don't want to say he was a bad person he just made a bad choice and of course I was hoping more for Ann and her family to get some sort of closure and I think they will get some in time.”
Carmona-Martinez apologized to the family and told the judge he takes full responsibility for his actions.
The undocumented immigrant will be deported once he finishes his prison sentence. He has a mandatory release date in 5 1/2 years and will get credit for 498 days served.
