Officials with York County announced they are dismissing the case against Scott Davis, the suspect in the Jordan Foltz burglary case.

York County officials say they are dropping the case because Greeley County officials are prosecuting Davis for theft involving the same property at the issue in the matter.

On September 3rd, Davis broke into a car and home of Jordan Foltz, brother of late Husker punter Sam Foltz, while the family was at the Nebraska Huskers football game in Lincoln.

Davis was pulled over in York County on September 4th for suspicion of drunk driving.

Davis was booked into the York County Jail.

Sheriff Dale Radcliff said deputies found items in Davis’ car that matched the description from the Foltz burglary, including a gas can with “Foltz” on it.

There were also stolen items from a construction company in Greeley as well.
