The family of a man shot and killed by police, is suing the city of Omaha for damages.
39-year-old Daniel Elrod was shot and killed by an officer in February of 2015.
Before the shooting.. Elrod had allegedly robbed a family dollar store near 13th and center.
Police say he was telling them he had a gun and even asked officers to shoot him. When he refused to follow police orders, he was shot.
The family is seeking damages for wrongful death and conscious pain and suffering.
A grand jury found no criminal wrong doing.
The officer who fired the deadly shot, Officer Alvin Lugod resigned a month after the incident.
