Special prosecutor appointed in Scurlock case

OMAHA, Neb. (KMTV) — Attorney Frederick D. Franklin has been chosen as the special prosecutor in the death investigation of James Scurlock, who was shot outside of The Hive bar in the Old Market during protests on May 30.

A grand jury will "convene on this matter as soon as feasible" due to restrictions in place to combat the spread of COVID-19.

Douglas County Attorney Don Kleine initially declined to pursue charges against the man who shot Scurlock.

Franklin formerly worked at the U.S. Attorney's Office in Omaha.
